How Does One Behave Toward a Relative who Does Not Pray?------------------------------------------------------
Question:
I have a brother-in-law who rarely prays. I live with my husband's family and [the female members of] his family sit with him even if the Imam is praying. What should I do? I am not one of his relatives (mahram). Is there any sin upon me since I do not have the ability to advise him?
Response:
If he does not pray, then he is deserving to be boycotted. You should not greet him nor should you respond to hit greeting, until he repents. This is because not praying is a great form of kufr [that takes one out of the fold of Islam]. This is true even if the person does not deny that it is obligatory. This is according to the most correct opinion among the scholars.
The Prophet (peace be upon him) said,
"The covenant that is between us and them [the disbelievers] is the prayer. Whoever abandons it has committed blasphemy."
This was recorded by Ahmad and the compilers of the Sunan with a sound chain. The Prophet (peace be upon him) also said,
"Between a man and disbelief and polytheism is the abandoning of the prayer."
This was recorded by Imam Muslim in his Sahih.
However, if a person denies the obligation of the prayers then he is a disbeliever according to the consensus of the scholars.
Therefore, it is obligatory upon his family to advise him and to boycott him if he does not repent. It is also obligatory to take his matter to the ruler for him to be asked to repent. If he repents, [that is accepted from him]. If he does not repent, he is to be killed.
This is because Allah has said in the Quran,
"But if they repent and offer prayer perfectly and give zakat, then leave their way free" (al-Tauba 5).
Also, the Prophet (peace be upon him) said, "I have been prohibited from killing those who pray."
These evidences show that one who does not pray is not to have his "way left free" and there is no prohibition against killing him if he is taken to the authorities and he does not repent.
And Allah is the One who provides guidance.

What is the best way to call those who do not pray? What about innovators?.
Answer :
Praise be to Allaah.
The best way to call those who do not pray can be summed up as follows:
1 – Reminding them of the obligation of prayer and that it is the greatest of the pillars of Islam after the Shahaadatayn (twin declaration of faith). 2 – Telling them of the stern warnings that have been narrated concerning not praying, and the different opinions of the scholars as to whether this constitutes kufr (disbelief) and riddah (apostasy). Islam does not give the one who does not pray the opportunity to live freely among people, because in his case he must he invited to pray, and if he persists in not praying, he is to be executed as an apostate according to the view of Ahmad and those who agreed with him among the salaf (early generations of Islam); or he is to be executed as a hadd punishment, according to the view of Maalik and al-Shaafa’i; or he is to be detained and imprisoned, according to the view of Abu Haneefah. But no scholar says that he is to be left free. So it should be said to the one who does not pray: are you happy that the scholars disagreed as to whether you are a kaafir and whether you should be killed or imprisoned?

It is permissible to have iftaar with non-Muslims if there is a shar’i reason for doing so, such as calling them to the true religion, or softening their hearts towards Islam, etc, which are what is hoped for if they come and eat iftaar at the tables set up for communal iftaar, as happens in some countries. But if it is done just to be friendly towards them and enjoy their company, this is a dangerous matter, because the principle of al-wala' wa'l-bara' (befriending the believers and showing enmity towards the disbelievers) is one of the basic principles of Islam, and one of the most important duties of the believers. ...

As for the traditions, al-Husayn ibn 'Ali related from his father that the Messenger of Allah said in respect of this matter, "Whoever curses a Prophet, kill him. Whoever curses my Companions, beat him."[7]about this book
In a sound hadith the Prophet commanded that Ka'b ibn al-Ashraf be killed. He asked, "Who will deal with Ka'b ibn al-Ashraf? He has harmed Allah and His Messenger." He sent someone to assassinate him without calling him to Islam, in distinction to other idol-worshippers. The cause of that lay in his causing harm to the Prophet. That indicates that the Prophet had him killed for something other than idol-worship. It was for causing harm. Abu Rafi,' who used to harm the Messenger of Allah and work against him, was also killed.
Similarly on the Day of the Conquest, he ordered the killing of Ibn Khatal and his two slavegirls who used to sing his curses on the Prophet.
In another hadith about a man who used to curse the Prophet, the Prophet said, "Who will save me from my enemy?" Khalid said, "I will," so the Prophet sent him out and he killed him.
Similarly the Prophet commanded that a group of unbelievers who used to injure and curse him, like an-Nadr ibn al-Harith and 'Uqba ibn Abi Mu'ayt, be killed. He promised that a group of them would be killed before and after the conquest. They were all killed except for those who hurried to become Muslim before they were overpowered. Al-Bazzar related from Ibn 'Abbas that 'Uqba ibn Abi Mu'ayt cried out, "O company of Quraysh, why is it that I alone among you am to be killed without war?" The Prophet said, "For your disbelief and your forging lies against the Messenger of Allah."
'Abdu'r-Razzaq mentioned that a man cursed the Prophet, causing the Prophet to say, "Who will save me from my enemy?" Az-Zubayr said, "I will." He sent az-Zubayr and he killed him.
It is related that a woman used to curse the Prophet and he said, "Who will save me from my enemy?" Khalid ibn al-Walid went out and killed her.
It is related that a man forged lies against the Prophet and he sent 'Ali and az-Zubayr to kill him.
Ibn Qani' related that a man came to the Prophet and said, "Messenger of Allah, I heard my father say something ugly about you, so I killed him," and that did not distress the Prophet.
Al-Mujahir ibn Abi Umayya, the Amir of Yemen, reported to Abu Bakr that a woman there in the time of the Ridda[8]chanted curses against the Prophet, so he cut off her hand and pulled out her front teeth. When Abu Bakr heard that, he said to him, "If you had not done what you already did, I would have commanded you to kill her because the hadd regarding the Prophet is not like the hadd regarding others."
Ibn 'Abbas said that a woman from Khatma[9] satirised the Prophet and the Prophet said, "Who will deal with her for me?" A man from her people said, "I will, Messenger of Allah." The man got up and went and killed her. He told the Prophet who said, "Two goats will not lock horns over her."[10]
Ibn 'Abbas said that a blind man had an umm walad who used to curse the Prophet. He scolded her and restrained her, but she would not be restrained. That night she began to attack and revile the Prophet, so he killed her. He told the Prophet about that and he said he had shed her blood with impunity.[11]

'Wage war' mentioned here means, oppose and contradict, and it includes disbelief, blocking roads and spreading fear in the fairways. Mischief in the land refers to various types of evil.

The fact that these groups are kaafirs is something concerning which there is no dispute among the Muslims. Rather whoever doubts that they are kaafirs is a kaafir like them. They do not have a status like that of the People of the Book or of the mushrikeen, rather they are misguided kaafirs and it is not permissible to eat their food, their women may be taken captive and their wealth may be confiscated. They are heretics and apostates whose repentance cannot be accepted, rather they should be killed wherever they are found, and they may be cursed because of what they are. It is not permissible to employ them as guards and gatekeepers. Their scholars and leaders must be killed, lest they lead others astray. It is haraam to sleep with them in their houses or to be friends with them, or to walk with them or to attend their funerals, if their death is announced. It is haraam for the Muslim authorities to neglect to carry out the hadd punishment that Allaah has enjoined by whatever means they see fit. And Allaah is the One Whose help we seek and in Whom we put our trust.

... I love my parents. I love them to want to guide them. But I will not accept from them to belittle Allah or His Messenger. I will argue (with respect) with them when they verbally abuse the Muslims. And if worse comes to worse, and I pray Allah never tests me with this, I will fight them to the death to defend my brothers and sisters. This is Islam.
